Can I Use Bankruptcy to Stop a Home Foreclosure?
Yes. If you have missed mortgage payments or were not able to pay off an expired balloon payment, the foreclosure process can be initiated by the lender. A Chapter 13 bankruptcy allows you to place an immediate stop to the foreclosure process called an "automatic stay." The automatic stay requires your creditors to stop their collection activities immediately. If your home is scheduled for a foreclosure sale, the sale will be legally postponed while the bankruptcy is pending — typically for at least three to four months.
